Welcome to Sudo Tickets

These Terms and Conditions govern your use of Sudo Tickets Enterprises' digital ticketing platform. Sudo Tickets Enterprises is a registered business under the laws of the Republic of Kenya, with its principal office at Kamukunji, Nairobi.

By using our platform, creating an account, or purchasing tickets, you agree to be bound by these terms.

1. Platform Services

Sudo Tickets provides comprehensive digital ticketing services including:

  • Digital ticket listing and publishing
  • Real-time ticket sales monitoring
  • Secure online payments processing
  • E-ticket issuance and QR-based verification
  • Post-event financial and performance reporting
  • Customer support related to ticketing

2. Commission and Payment Terms

Service Commission

Sudo Tickets charges a commission of 10% to 15% on gross ticket revenue for each event.

Payment Schedule:

  • Payouts are made immediately after event conclusion and final sales reconciliation
  • Payments are processed via Stanbic Bank to the account details you provide
  • You are responsible for providing accurate banking information
  • Sudo Tickets is not liable for delays caused by incorrect account details or banking issues

3. Event Organizer Responsibilities

As an event organizer using our platform, you must:

  • Provide accurate event details (name, venue, date, ticket types, and prices)
  • Obtain all required event licenses, venue permissions, and regulatory approvals
  • Define and publish a clear refund and cancellation policy
  • Not duplicate or sell tickets outside the Sudo Tickets platform without written consent
  • Use customer data only for event-related communication, complying with data protection laws
  • Ensure your event complies with all local laws and regulations

4. Ticket Purchases and Attendance

For Ticket Buyers:

  • All ticket sales are subject to the event organizer's terms and conditions
  • Tickets are issued as QR-coded e-tickets for verification at events
  • You must present valid e-tickets for event entry
  • Ticket prices include applicable service fees
  • Resale restrictions may apply as determined by the event organizer

5. Refunds, Cancellations & Disputes

Important Refund Policy

Event organizers bear full financial responsibility for refunds in cases of event cancellation or disputes.

  • Tickets are only eligible for a refund before the event takes place. Refund requests made after the event will be automatically declined.
  • Sudo Tickets may assist in managing refunds but will not provide funds for refunds
  • In case of event cancellation, Sudo Tickets will withhold funds until customer refunds are processed
  • Refund eligibility and processing times are determined by the event organizer's policy
  • Disputes should first be resolved directly with the event organizer

6. Fraud Prevention and Platform Integrity

Zero Tolerance Policy

Any attempt to bypass the platform, duplicate tickets, or mislead customers will result in immediate account termination.

Prohibited activities include:

  • Selling tickets outside the platform without authorization
  • Creating duplicate or fraudulent tickets
  • Providing false or misleading event information
  • Misusing customer data or violating privacy regulations

Consequences: Sudo Tickets reserves the right to withhold all revenue pending investigation or legal action.

7. Data Use and Privacy

We are committed to protecting your privacy in accordance with Kenya's Data Protection Act, 2019:

  • Customer data collected via Sudo Tickets is shared with event organizers for event-related purposes only
  • Event organizers must maintain strict confidentiality and not resell or misuse attendee data
  • All parties must comply with applicable data protection laws
  • Personal information is processed securely and used only for legitimate business purposes

8. Limitation of Liability

Sudo Tickets provides the platform "as is" and is not liable for:

  • Event failure, cancellation, or poor attendance
  • Power outages or technical failures beyond our control
  • Acts of God, natural disasters, or force majeure events
  • Venue-related issues or problems
  • Third-party payment processing delays

Total liability in any case is limited to the commission earned from the specific event in question.

9. Account Termination

  • Either party may terminate their account with 7 days' written notice
  • Immediate termination may occur in cases of fraud, breach, or misconduct
  • All completed event payments and obligations prior to termination will be honored
  • Termination does not affect ongoing events or pending financial obligations

10. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the Republic of Kenya. All disputes shall:

  • First be resolved through good faith negotiations
  • If unresolved, be submitted to courts of competent jurisdiction in Nairobi, Kenya
  • Be conducted in accordance with Kenyan legal procedures

Legal Agreement Acknowledgment

By using the Sudo Tickets platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. This agreement constitutes the full understanding between the parties and supersedes all prior discussions or agreements.
